The company provides certain services related to facilitating email marketing and SMS marketing activities.
Compliance with the Regulation constitutes a condition of use of the system owned by White Image and is valid for the prohibition of spamming.
The User is not entitled to use the system owned by White Image to send unsolicited emails ("spam"), regardless of whether they are for commercial or non-commercial purposes. The emails in the User's database are considered to be unsolicited if the subscriber addresses are not fully approved by the User's subscribers. If the User has obtained the email addresses through the harvesting procedure, or has purchased them, or has another list of subscribers (even with the approval of the list owner), or if he has created the respective list by any other method than by direct subscription of his subscribers, then the emails sent to the respective subscribers are considered unsolicited (so they are not received by the subscribers by their option, therefore they are considered to be "spam").
In the event that White Image receives complaints that the User is sending unsolicited commercial or non-commercial emails (i.e. "spamming"), in addition to any other rights that White Image may have under the Agreement and under applicable law, White Image may - at its discretion - suspend the User's services until the User reconfirms the entire subscriber list. Such reconfirmation may be requested by White Image in any manner it may deem reasonable, including, but not limited to, sending a single email to all subscribers on the list, requesting confirmation of their desire to remain on the list.
White Image agrees to use commercially reasonable efforts to contact the designated list administrator by email or telephone prior to suspending service. Before sending the reconfirmation message to the User's subscribers, White Image must request the User's consent. However, if the User does not consent to the Agency contacting its subscribers for reconfirmation, White Image may terminate this Agreement.
If White Image establishes in good faith that spamming has occurred, in addition to any other rights it has under this Agreement and the legislation in force, White Image shall issue a single warning sent to the Client requesting the cessation of the respective activity, and if the spamming activity continues, White Image may initiate legal action in a competent court to prohibit such activity (it being understood that such activity may cause White Image irreparable damage) which cannot be fully compensated by the payment of damages, and White Image may recover from the User the pecuniary losses caused.
Other unacceptable uses by the Client:
You may not use the White List Manager system for hosting subscriber lists for the following purposes:
1. Sending emails with invalid "From:" or "Reply-to:" addresses. All messages sent to subscribers on the User's lists must contain valid email addresses, and the User must respond to all replies from subscribers on his lists, including unsubscribe requests. He has no right to refuse or ignore unsubscribe requests from subscribers on his lists
2. Also, the User does not have the right to harass, threaten, embarrass or cause inconvenience, insist or create discomfort to any natural or legal person.
3. Has no right to display or transmit sexually explicit images or any other content that White Image considers offensive.
4. It has no right to transmit any content element that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene or inciting hatred, as well as any content element involving racism, anti-ethnicity or against which one can object in any way, or which may violate the rights of third parties, as deemed by the Agency.
5. You may not assume the identity of any false person, nor may you communicate under a false name or a name that you do not have the right to use.
6. He has no right to intentionally or unintentionally violate any legislative act
Confirmation of subscriber status:
The User is obliged to use a "double opt-in" subscription method (i.e. both subscription and confirmation) for all new subscribers on the list. The confirmation email sent by the Client to new subscribers cannot include advertisements or requests (calls-to-action) other than the request to confirm the subscription. If new subscribers who have not confirmed (i.e. subscribers who have completed only one of the two subscription steps) are imported or if advertising messages or any other requests (calls-to-action) are included in the confirmation message, then it must be taken into account that this is done at the User's risk and that, in the event of spamming complaints, White Image reserves the right to proceed in the manner explained in the section entitled "Prohibition of spamming".
Opting
All messages to all subscribers on the list must include unsubscribe instructions in the body of the message at the bottom, so that subscribers can unsubscribe themselves.
List owners must respond to requests from subscribers to be manually removed from lists, politely and promptly. The User must not ignore personal emails he receives regarding unsubscribing from his lists. Even if the unsubscribe request from the subscriber is aggressive, threatening or otherwise rude, the User must still try to help the user unsubscribe from the respective list and resolve the problem.
Violation of the Regulation
If the User violates the provisions of these Regulations, White Image has the right at its discretion to delete the User's list from its server and to cancel the User's right to use the White Image services. List owners must bear in mind that they are responsible for the behavior of subscribers on their lists.
Respect for privacy
White Image is committed to respecting the privacy of the User and its subscribers
1. White Image treats private communication on or through the White List Manager system for hosting subscriber lists with strict confidentiality.
2. For the User's protection, White Image strongly recommends never giving their subscriber list to anyone.
